Ensil's Warranty

ENSIL provides a limited repair warranty on work performed at the time of shipping from its facilities to the customer for a period of 120 days on parts and labor. This limited repair warranty is non-transferable and does not cover software or firmware embedded in circuit boards or damages resulting from shipping or packaging, Electro Static Discharge, abuse, installation or tampering by unauthorized persons. Ensil’s limited warranty covers only the work performed by Ensil on the original defect. Ensil makes no other warranties or promises expressed or implied by operation of law or otherwise including without limitation, any warranties of non-infringement, merchantability or fitness for a particular purpose or use, or any expressed or implied warranties of contract terms or amendments arising out of course of performance to the maximum extent permitted by applicable law and, in no event shall Ensil be liable for any indirect, special, incidental or consequential damages arising from repair work performed by Ensil on these products. Ensil reserves the right to inspect the product for which warranty claims are made. All sales and services performed by Ensil are final, no refunds or charge back are allowed or permitted.

CUSTOMER AGREES THE WARRANTY TERMS AND CONDITIONS INCLUDING THE INVOICE TERMS ON THIS INVOICE SUPERSEDES ALL OTHER TERMS AND CONDITIONS PREVIOUSLY AGREED ON BETWEEN ENSIL AND CUSTOMER. PAYMENT OF THIS INVOICE CONSTITUTES THE ACCEPTANCE OF ENSIL'S WARRANTY TERMS AND CONDITIONS.

Any dispute regarding this warranty shall be governed by the laws of the State of New York and any action brought related thereto shall be brought in the United States District Court for the Western District of New York.
